Terms and Conditions

General

The following general terms and conditions apply exclusively to all offers, contracts and deliveries. Deviating agreements are only valid if they have been accepted by us in writing. Conflicting terms and conditions of the buyer do not apply, even if we have not expressly objected to them. Offers made by us are always subject to change. Subsidiary agreements generally require our written confirmation, otherwise they are not deemed to have been agreed.

Contracts

Payment of the invoice we send is considered confirmation of the order and is binding from that point on. Otherwise, the statutory regulations apply with regard to compliance and/or termination of contracts.

Payment
Payment is only made in advance.

Production

Production only begins after receipt of payment, depending on the order situation and the corresponding waiting time. All order details must be clarified before production begins. Changes after production has begun are no longer possible.

Delivery time and deliveries

The delivery time is calculated individually for each individual order, depending on the effort and quantity, but can vary due to peak times and orders. If the customer wants a fixed delivery date, this must be agreed in writing. We provide a corresponding form for this. Without this written agreement, our general delivery times apply. The goods are generally shipped with DHL, unless otherwise agreed. The buyer bears the shipping costs. The goods are shipped insured unless otherwise agreed.

Complaints

Because the goods are manufactured on your behalf, there is no right of cancellation, return or exchange (https://www.gesetze-im-internet.de/bgb/__312g.html , https://curia.europa.eu/juris/liste.jsf?language=de&num=C-529/19). Whether a replacement service, a discount or the complete return of the delivery is granted will be decided by us on a case-by-case basis. Claims for conversion or compensation, in particular for consequential damages, are excluded. Also excluded are defects that have arisen due to transport, improper handling, changes to the delivered item or natural wear and tear. Commercially customary or minor, technically unavoidable deviations in quality, color, width, weight, equipment or design may not be complained about. We expressly point out that technical deviations in color and quality may occur during the production of articles.

Proprietary rights
The goods delivered remain our property until all existing claims have been settled. The extended and expanded proprietary rights apply.

Fulfillment and jurisdiction
The registered office of Cowpunk Leather is expressly agreed as the place of performance and jurisdiction. The law of the Federal Republic of Germany applies.
